Changes the incarceration maximum term for gross misdemeanors from 365 days to 364 days.

  • Revolves the inconsistency between how state and federal law views misdemeanors v. felonies.
  • Allows Minnesota to decide if a state court matter is a felony or not.
  • Reduces unfair and arbitrary collateral consequences caused by the inconsistency.
